3. Pricing & Payment

All prices are listed in GBP (£) and exclude VAT - This is calculated in the checkout.

4. Delivery

All equipment must be installed and used in accordance with manufacturer guidelines and relevant safety regulations. GearGuard Ltd accepts no liability for improper installation or use.
6. Limitation of Liability

We are not liable for indirect or consequential losses (e.g. loss of production)

Our liability is limited to the value of the goods supplied

This does not affect your statutory rights under UK law
7. Intellectual Property
All website content (logos, text, images) remains the property of GearGuard Ltd and may not be reused without permission.
8. Governing Law
These terms are governed by the laws of England and Wales.

RETURNS & REFUND POLICY
9. 30-Day Return Policy
You have the right to return items within 30 days of delivery.
To be eligible for a return:

Items must be unused and in original condition

Items must be returned in original packaging

Proof of purchase is required
10. Non-Returnable Items
Unless faulty, the following cannot be returned:

11. How to Return an Item

Customers are responsible for return shipping costs unless the item is faulty.

13. Faulty or Incorrect Items

14. Warranty
Products supplied by GearGuard Ltd include a warranty period of 3 to 12 months, depending on the item.
Warranty covers:

Damage caused by external factors
Warranty claims are assessed on a case-by-case basis.
15. Your Legal Rights

“Customer” means any business, trade, or commercial entity purchasing goods or services

“Goods” means products supplied by the Company

“Services” means installation, maintenance, repair, or consultancy work
2. Basis of Contract

These terms apply to all B2B sales and services

Any conflicting terms from the Customer are excluded unless agreed in writing
-
Orders are only accepted once confirmed in writing by the Company
3. Pricing & Payment

All prices are exclusive of VAT unless stated otherwise
-
Payment terms: proforma, 30 day or at checkout. Invoices or 30 Day accounts must be agreed up-front, subject to credit.

Late payments may incur:

Interest under the Late Payment of Commercial Debts (Interest) Act 1998

Recovery costs

The Company reserves the right to suspend supply if payment terms are not met
4. Delivery & Risk

Delivery dates are estimates only

Risk passes on delivery

Title (ownership) does not pass until full payment is received
5. Retention of Title
All goods remain the property of GearGuard Ltd until paid in full.
We reserve the right to:

Recover goods if payment is not made

Enter premises (if necessary and lawful) to retrieve goods
6. Installation & Use

The Customer is responsible for ensuring:

Safe installation

Proper use in accordance with manufacturer guidance

Compliance with relevant regulations (e.g. HSE requirements)

GearGuard Ltd is not liable for:

Improper installation (unless carried out by us)

Misuse or modification of equipment

7. Product Suitability

The Customer is responsible for ensuring goods are suitable for their intended application

Technical advice provided is guidance only and does not constitute a guarantee
8. Returns (B2B)
Unlike consumer sales, returns are not automatically accepted.
We may accept returns at our discretion if:

Items are unused and in original condition
-
Return is requested within 14 days
-
A restocking fee may apply
Custom or special-order items are non-returnable.
9. Faulty Goods

Faults must be reported within 48 hours of delivery

10. Warranty

Goods carry a 3–12 month warranty depending on the product

Warranty covers manufacturing defects only
Warranty excludes:

Wear and tear

Improper installation

Lack of maintenance

Damage caused by external factors
All warranty claims must be assessed by GearGuard Ltd before approval. The Customer acknowledges that improper installation, calibration, or maintenance of equipment may result in operational failure. GearGuard Ltd accepts no liability for losses arising from such issues unless installation has been carried out directly by GearGuard Ltd.
11. Limitation of Liability
To the fullest extent permitted by law:

Loss of profit

Loss of production

Downtime

Indirect or consequential losses

Total liability is limited to the value of the goods or services supplied
12. Indemnity
The Customer agrees to indemnify GearGuard Ltd against:

Claims arising from misuse of products

Improper installation

Failure to comply with safety regulations
13. Force Majeure
We are not liable for delays or failure to perform due to events beyond our control, including:

Supply chain disruption

Transport issues
-
Industrial action
-
Natural events
14. Intellectual Property
All designs, drawings, documents, and materials remain the property of GearGuard Ltd.
15. Termination
We reserve the right to terminate contracts if:

Payment terms are breached

The Customer becomes insolvent
-
There is a material breach of contract
16. Governing Law
These terms are governed by the laws of England and Wales.
